Fair Civil Justice welcomes the publication of the 2025 Class Actions Report, produced by Kendal Global Advisory in partnership with law firm Faegre Drinker, which reveals growing concern among UK businesses about the direction of the country’s collective actions regime.
Drawing on interviews with 23 leading companies – together representing over £8 trillion in market capitalisation – and polling of 2,000 adults by Ipsos, the report provides one of the most comprehensive pictures to date of how class actions are affecting both businesses and consumers.
The research finds that companies are setting aside tens of millions of pounds each year to defend claims, with all interviewees calling for reform. Many raised concerns about the UK adopting aspects of a US-style litigation culture that could divert resources away from innovation, jobs, and growth.
For consumers, engagement remains limited and understanding inconsistent. Only 17% of adults reported ever seeking compensation from a business, and just 8% said they had done so through a class action. The polling also uncovered widespread confusion over key legal terms. As the Solicitors Regulation Authority reviews the use of “no win no fee”, the findings suggest a need for clearer, more transparent communication when consumers enter into legal agreements.
The report includes a foreword by our Executive Director, Seema Kennedy OBE, who reflects on the importance of creating a system that supports genuine redress without undermining responsible business.
