Litigation funding is no longer the cottage industry it was 15 years ago, but a multibillion pound one that played a significant role in the civil justice system. The current self-regulatory model is no longer appropriate and policymakers must consider statutory regulation that gives transparency and accountability – licensing by an independent supervisory authority, mandatory disclosure of funding agreements to the courts and a requirement for funders to demonstrate that they have adequate capital to satisfy their financial obligations.
