A Channel 4 News investigation has exposed one of the most troubling consumer scandals in recent years. Thousands of homeowners – already suffering from the fallout of the cavity wall insulation crisis – have been left facing crippling debts after being misled by law firms promising “no win, no fee” representation.
As Fair Civil Justice Executive Director Seema Kennedy OBE told Channel 4 News:
“They might have been sold something called ‘no win, no fee’ without really understanding what this means for them as a consumer, because ‘no win, no fee’ doesn’t mean no risk.”
The report reveals how some legal firms have exploited confusion around the “no win, no fee” model, leaving consumers financially exposed despite assurances that they would not face costs if their claims failed. The fallout has been particularly acute in communities already affected by the UK’s cavity wall insulation programme.
At Fair Civil Justice’s recent Access to Justice event at the Labour Party Conference in Liverpool, campaigners and local MP Oliver Ryan discussed victims of cavity wall and the urgent need for reform of claimant firm activity. The message from both consumers and policymakers was clear: stronger regulation, greater transparency, and earlier oversight are essential to restore trust and fairness in the civil justice system.
Fair Civil Justice continues to call for better public understanding of legal agreements and for tighter regulation around the use of “no win, no fee” terms. Consumers must be able to make informed choices without fear of hidden costs or financial harm.
